The Belt and Road Initiative(BRI), a courageous master plan to tackle the common problems facing the BRI related countries as long as the world by promoting the provision of international public goods, is a bold move to dismantle the contemporary global political and economic order. To implement the BRI smoothly, one needs to hold a reflective attitude towards the existing international legal order, which should largely be responsible for the wide-ranging under-provision of international public goods and strives for a more just and reasonable Chinese discourse of international law. The proposition of Chinese discourse of international law is a denial of the international law which is deeply ingrained with “Eurocentrism” and aims to pierce the long-hidden discourse hegemony beneath the benign rules of international law. To construct the Chinese discourse of international law under the BRI, one should take China s unique historical and cultural traditions as well as its recent experience on economic and social reform into consideration, and foregrounds the Five Principle of Co-existence and the idea of Common Destiny of Humankind as the guiding principles and take concrete measures to cater to the effective provision of international public goods on sound and contingent basis.
