论设计保护的功能性原则 预览

摘要 良善设计是产品取得市场成功的重要因素,在符合知识产权部门法规定的条件下,它分别作为实用艺术作品、外观设计、立体商标(三维标志)、商品外观而得到保护,其共同之处是:不保护功能性的设计。功能性原则是区分设计保护与发明(以及实用新型)专利的基本原则,还是设计受交叉保护的制度依据;但它不应是版权法、专利法、商标法和反不正当竞争法对设计区别保护的标准。功能性原则的具体判断标准必须回应设计产业的创新实践需求,同时,它也不应影响知识产权部门法保护设计的其他条件。应以“技术功能”为标准,在承认设计特征三分法的基础上,确定“功能性和装饰性兼具的设计”受保护的地位,但其保护范围应与装饰性的强弱相关联,以实现激励设计创新的目标。 Good design,which is one of the most important factor for the success of the product,is respectively protected as works of applied art,design,three-dimensional trademark and trade dress under different conditions of intellectual property laws,but its common feature is that it does not protect functional design.Functionality doctrine is the basic standard for distinguishing protection between design protection and invention(including utility model)patents,also is the institutional basis for interface protection for design,but it is not a doctrine for distinguishing design protection among copyright law,patent law,trademark law and unfair competition law.The specific standard for functionality doctrine should meet the demands of innovative practice in design industry,and it should not affect other requirements of the intellectual property laws for design protection.It should apply the standards of“technical function”and recognize the three classification of design,thus protect the design that has“functional and decorative nature”.However,its scope of protection should be related to the decorative strength in order to achieve the goal of encouraging design innovation.
